Terms & Conditions

1. About these terms

These terms govern the supply of fall protection inspection, certification, and installation services by Sky Height Safety, a trading division of Hoists and Cranes UK Limited (the “Supplier”) to the client named in the relevant quotation or order (the “Client”). By placing an order or accepting a quotation, the Client agrees to these terms.

2. Scope of services

The Supplier will provide the services specified in the written quotation or order acknowledgement. All services are performed against current British Standards, including but not limited to BS EN 795, BS 7883:2019, BS EN 365, BS EN ISO 14122, and BS 6180, as applicable to the relevant system type.

3. Quotations and orders

Quotations are valid for 30 days from issue unless otherwise stated. A binding contract is formed when the Client accepts a quotation in writing (including by email) or issues a corresponding purchase order. Variations to the scope must be agreed in writing.

4. Pricing and payment

All prices are exclusive of VAT, which is charged at the prevailing rate. Payment terms are 30 days from the date of invoice unless otherwise agreed in writing. The Supplier reserves the right to charge statutory interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.

5. Access and site readiness

The Client is responsible for providing safe and timely access to the relevant building, roof, plant area, or other site at the agreed visit time. Where access is delayed or refused, the Supplier reserves the right to charge an abortive visit fee equivalent to the planned engineer day rate plus reasonable travel costs.

6. Inspection findings and remediation

Inspection reports record the condition of the inspected systems against current British Standards at the date of inspection. The Supplier accepts no liability for the condition of any system between inspection visits. Where remediation is recommended, the Client remains responsible for commissioning the remediation work and for restricting access to any system flagged as non-compliant until remediation is complete.

7. Installation work

Installation work is performed against current British Standards and the manufacturer's installation specification. Installation certificates are issued on completion. The Supplier provides a 12-month warranty on workmanship from the date of installation certification, in addition to any manufacturer's product warranty.

8. Liability

The Supplier's total liability under or in connection with the services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the total fees paid by the Client for the relevant order. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited.

9. Cancellation

Either party may cancel a scheduled visit by giving at least five working days' notice. Cancellations with shorter notice may incur an abortive visit fee.

10. Confidentiality and data protection

Each party will keep confidential the other party's confidential information and process any personal data in accordance with the UK GDPR and the Data Protection Act 2018. See our Privacy Policy for further detail.

11. Governing law

These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
